Operating licenses will be granted in a single procedure

Through the approval of the Uniquely Ordered Text (TUO) of Law 28976, “Framework Law for Operating Licenses”, the executive branch has ordered the new requirements for the granting of the operating licenses. Previously, the local governments will be in charge of evaluating the zoning and compatibility of use, as well as the safety conditions of the building.
The operating license will be granted in a single administrative procedure. Buildings that receive the qualification of low or medium risk level will receive an automatic approval, which does not exempt them from submitting the sworn statement of compliance with safety conditions; in the case of buildings with high and very-high risk level will be evaluated with positive administrative silence.
According to the new law, all individuals, legal entities or collective entities, national or foreign, that develop commercial, industrial and/or service activities prior to their respective opening will be benefited with the granting of the operation license. Also included in this group are the establishments of State, regional and/or municipal companies or entities.
