Patents and Trademarks as a source of bank financing: The Proposal of Indecopi

The acceptance of patents and trademarks as a source of collateral for securing bank financing was an initiative presented by Indecopi during the High-Level Conference organized by IBEPI (Programa Iberoamericano de Propiedad Industrial y Promoción del Desarrollo) in Madrid in early October.
The Executive President of Indecopi, alongside other authorities from national intellectual property offices, participated in a panel discussion where she presented the challenging and innovative proposal to consider patents and trademarks for securing corporate bank financing. She explained that to make this concept viable, mechanisms among the intellectual property, financial, and business development systems must be strengthened and articulated.
The Value of Intangible Assets as Collateral for Businesses
Despite possessing economic value, the use of intangible assets as collateral continues to encounter obstacles regarding acceptance by the financial sector. Patents, trademarks, industrial designs, and utility models all provide legal protection to creations and distinctive signs tied to commercial activity.
Beyond promoting agreements or cooperation initiatives, the underlying challenge consists of incorporating these assets into corporate innovation processes and business strategies that position them as a viable financing alternative for enterprises regardless of their scale.
