New legal provisions are issued for hiring venezuelans

Through the publication of a Ministerial Order, issued by the Ministry of Labour, the Peruvian government announced new legal provisions that already apply for the employment of Venezuelan citizens in the national territory.
According to the Ministerial Order N° 176-2018-TR, published in the official journal “El Peruano”, every Venezuelan citizen who has a PTEP (Extraordinary Temporary Work Permit) or a PTP (Temporary Residence Permit) will be able to sign a written work contract, which should not be greater than the time of permanency that is recorded in the valid migration document. Every PTP or PTEP that has expired or the failing to obtain the permission will terminate automatically the work contract.
In the case of employers, they must observe what is established in the Act for Hiring Foreign Workers, when it refers to their presence must be equal to 20% of the total number of workers in the payroll and 30% of the total remuneration.
