Trademark and Patents shall be published in The Electronic Gazette of INDECOPI in Peru

Within the framework of bureaucratic barriers removal and in order to strengthen the faculties of The National Institute of the Defense of Competition and Protection of Intellectual Property – INDECOPI, The Peruvian State, through Legislative Decree N° 1212, has implemented the creation of an Electronic Gazette dedicated for Intellectual Property affairs under the management of INDECOPI whereby this institution will carry out publications of trademarks and inventions.

One of the main purposes of the referred Gazette is to reduce the required time of the procedures from 180 to 45 days for INDECOPI to recognize the trademark or invention right.

For instance, if a brand has already the publication order until June 30, nowadays shall suffice the sole request to the competent department to get the publication order be displayed on the Electronic Gazette of Industrial Property Department, remaining as an alternative the publication in the Gazette “El Peruano”.

If trademark applications have complex ex officio adjustment, the Applicant will be notified in order to make the rectifications designated by the authority within the term of fifteen working days for overcoming the raised objections, otherwise the Authority shall proceed to publish the trademark in the Official Electronic Gazette in accordance with the Distinctive Signs Direction.

The mentioned notification shall not apply for the ex officio modifications wherein the administration has not made any substantial changes, proceeding to publish the trademark application automatically.

The extract of the application that will be published may contain the following information:

a) Number and filing date of the application.
b) Name and Country of Incorporation of the Applicant(s).
c) Complete information of the claimed priority or priorities, or if a preferential right is being exercised.

At the same time, the mentioned gazette will allow any review of the registered or pending applications, which could be seen through the official web site of INDECOPI.
