INDECOPI dictates measure in favor of the Peruvian consumers

The National Institute for the Defense of Competition and Intellectual Property (INDECOPI) has considered introducing some modifications regarding the regulations for the registration of trademarks in Peru. Thus, since the month of February becomes effective the Resolution No. 4665-2014 / TPI-INDECOPI, which has the faculty to determine the validity and binding fact of a trademark coexistence agreement.
As stated in the Resolution, the requirements that must be fulfilled strictly are to indicate clearly the delimitation of territory, delimitation of product or service, as well as the delimitation of the form of use and / or presentation of the distinctive sign.
The measure aims to provide consumer protection, preventing them from being induced to mislead or fraud by two similar trademarks.
