Authorities reactivate public procurement

In accordance with the stipulations of D.S. No. 168-2020-EF, public entities are obliged to request contractors to submit health and administrative documents, in physical or virtual format, that allow the reactivation of contracts for goods and services that were suspended due to the State of Health Emergency, within a period not exceeding seven working days after the completion of the immobilization and/or resumption of activities in the geographical area where the contract is executed.

Likewise, it is possible for the contractor to request an extension of the contractual period by submitting a request and identifying the pending services to be provided. The approval of the request for modification will be communicated through a notification, which will be considered to have accepted the content and avoid a subsequent signature of the document.

On the other hand, public entities are only authorized to incorporate modifications in contracts when it is a question of preventive measures against Covid-19, having to recognize the cost it demands.
