The requirements for a Transfer of Ownership in Argentina have been simplified. Under Resolution No. 162/2026 issued by the INPI (National Institute of Industrial Property), the primary authority on industrial property matters, the process aims to enhance competitiveness and streamline procedures for domain transfers and changes of business scope.
Below are the key updates:
Elimination of Apostilles and Consular Legalizations: These requirements have been removed exclusively for documents executed outside Argentina. This exception applies solely to the document process for a transfer of ownership and does not alter the requirements for other procedures.
Language requirements: Documents must be submitted fully translated into Spanish. If a document is in another language, it must first be translated and subsequently legalized.
Affidavit-Based Filings Documentation including powers of attorney must now be submitted under penalty of perjury as a sworn declaration reinforcing the responsibility of the involved parties regarding authenticity and accuracy.
Greater Flexibility for Registration Requests: Either the assignor or the assignee/acquirer is now eligible to apply for the registration of a transfer.
Effectiveness Against Third Parties: Since the registry is declarative in nature, legal effects regarding third parties will take effect as of the application filing date with the INPI.
New Error Correction Procedure: Applicants now have the opportunity to address observations or rectify documentation before an application is officially rejected.
