Cohabitants can register their partnership with SUNARP

Contrary to what was thought, the common-law marriage or cohabitation is a practice that must be registered before the Personal Registry of the SUNARP (National Superintendence of Public Registries) and in this way avoid an unfair redistribution of the assets of each of the members of the couple, even more so when there is a prior knowledge of the ownership of the assets (movable and immovable) of each one of them.
Although it may appear to be an informal marriage, from a legal point of view, the cohabitation is nothing more than a property partnership that after two years corresponds to the regime of community of property, i.e. all assets and income obtained during the period of cohabitation belong to the spouses in equal shares.
According to the authorities during the year 2021 and with the state of emergency caused by the Covid-19, 3,664 unions were registered, of which 985 correspond to Lima.
