{"id":4114,"date":"2020-04-20T14:38:53","date_gmt":"2020-04-20T19:38:53","guid":{"rendered":"https:\/\/omcabogados.com.pe\/?p=4114"},"modified":"2023-08-06T14:40:31","modified_gmt":"2023-08-06T19:40:31","slug":"requisitos-para-aplicar-la-suspension-laboral-perfecta","status":"publish","type":"post","link":"https:\/\/omcabogados.com.pe\/es\/requisitos-para-aplicar-la-suspension-laboral-perfecta\/","title":{"rendered":"Requisitos para aplicar la Suspensi\u00f3n Laboral Perfecta"},"content":{"rendered":"<p>A partir de la publicaci\u00f3n en el diario El Peruano del Decreto Supremo N\u00b0 011-2020-TR, han quedado establecidas las condiciones que debe cumplir el empleador para proceder con la Suspensi\u00f3n Laboral Perfecta, tomando en cuenta que se trata de una medida de excepci\u00f3n que solamente se podr\u00e1 aplicar cuando el empleador haya agotado todas las posibilidades para mantener la cadena de pagos y de empleos de sus trabajadores.<\/p>\n<p>De acuerdo al reglamento, la norma comprende a empleadores y trabajadores del sector privado (micro, peque\u00f1a, mediana y gran empresa), bajo cualquier r\u00e9gimen y que por la naturaleza de las actividades de la compa\u00f1\u00eda sea imposible que se aplique el trabajo remoto, una licencia con goce de haber o si la empresa se encuentra en mal estado econ\u00f3mico. Est\u00e1 condici\u00f3n ser\u00e1 calculada en base a las remuneraciones que pagan seg\u00fan la planilla electr\u00f3nica y el nivel de ventas de cada empresa.<\/p>\n<p>En caso de que la empresa brinde informaci\u00f3n o documentaci\u00f3n falsa para aplicar esta medida laboral se har\u00e1 merecedor a una multa (de 5 a 10 UIT) y sanciones penales, el hecho ser\u00e1 denunciado ante el Ministerio P\u00fablico, adem\u00e1s el empleador estar\u00e1 obligado a efectuar el pago del \u00edntegro de las remuneraciones y ordenar la reincorporaci\u00f3n del empleado a las actividades de la
