A Century of Protection for Industrial Designs

This November marks 100 years since Industrial Designs first received international legal protection, following the creation of the Hague System which today operates under the administration of WIPO: the World Intellectual Property Organization. In its early years, the system included 11 signatories; today, 82 States are members, including Japan, the Republic of Korea, the United States, Russia, Canada, the United Kingdom, Israel, Mexico, China, Brazil, Saudi Arabia, and Uzbekistan.

According to the Hague System, the protection of industrial designs is granted internationally and simultaneously. Designers receive immediate rights to distribute and license their industrial drawings and designs in sectors such as stationery, watchmaking, textiles, communications, machinery, transportation or lifting equipment, and travel goods.

How can an industrial design be protected in Peru?

To obtain international protection for an industrial design, the following steps must be completed:

Submit an industrial drawing or design application to National Institute for the Defense of Competition and Protection of Intellectual Property (INDECOPI).

Undergo “Form” and “Content” evaluation

Pay the applicable fees
